Innovationclub S.R.L. collects and uses your personal data when you browse or use the related online services available at https://www.chargecar.com.
By personal data we mean any information that can be used to identify you as an individual.
Our Company has always protected the personal data of its customers and guarantees the utmost commitment to manage it carefully, to keep it safe and to meet the requirements of the new European Regulation no. 679/2016 (hereinafter “GDPR”).
The purpose of this policy is to provide you with a clear and detailed explanation of how, when and why we collect and use your data. It is designed to provide you with a simple and transparent explanation of our personal data protection policy and how to effectively exercise your rights.
Innovationclub S.R.L. also wants to ensure that you are always aware of any changes made to this privacy policy by sending an e-mail message to the address you provide us or by posting a notice on the site: in this way, you will be constantly informed about the impact of activities regarding your personal data.

1. Who is the data controller of my data?
Since Innovationclub SRL, PI 03945110363, determines the means and purposes of processing your personal data, it is deemed the Data Controller. You can contact Innovationclub SRL using the addresses illustrated in the section “How can I contact the Data Controller or handle my complaints?”.

2. When do you collect my data?
Innovationclub S.R.L. will collect the information directly provided by you:
• when you access and browse the site;
• when you have questions or advice to submit and use the contact sections dedicated to it;
• when you want to contact us to become a collaborator through the dedicated section;
• when you sign up and sign in to your personal account.

3. What data will you process?
When you browse, use services or make purchases on the Innovationclub SRL website, the following types of data may be processed:

a) Navigation data
Some personal data whose transmission is implicit during website navigation, including, but not limited to data traffic and concerning location, weblog and other communication data for any billing purposes or concerning the resources accessed through the device, are acquired by computer systems that allow them to function correctly. Even if this information is not collected to be associated with identified data subjects, it could allow users to be identified – by its very nature and through processing and association with data held by third parties. For example, this data includes the IP addresses or domain names of the computers used by users connecting to the site, the URL addresses of the requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, the numeric code indicating the status of the response given by the server and other parameters related to the operating system and to the platform operated by the user.

b) Data provided voluntarily by the user (Information request)
You can contact us at the addresses indicated in the Contacts section of the site to request information or assistance. This involves the subsequent acquisition of the data you have communicated to us (for example, your e-mail address and the information contained in the communication) and implies that you authorize us to send you any response communications using the addresses you provided at the time of requesting and/or registering with the site.

c) Data provided voluntarily by the user (Collaboration Information request)
In the “Collaboration” section you can contact us, to request information and/or provide us with information for a possible collaboration. This involves the subsequent acquisition of the data you have communicated to us (for example your email address and the information contained in the communication) and implies that you authorize us to send you any response communications using the contact details you provided at the time of requesting and/or registering with the site.

d) Data provided voluntarily by the user (access and registration to the account)
You can create a personal account by filling out the form in the “Chargecar” section.
For registration and access to the reserved area, personal data of the user and/or those that identify him/her, such as username and password and contact details, in addition to identification data, are collected.
Once you have created your personal account, information about your identification and contact details, your activities and our services will be kept on your page. You can always manage your information, either directly from your account or by making a specific request.

e) Sending communications for marketing and/or commercial promotion purposes in the context of soft-spam
In the sole case in which personal data (in particular, e-mail address and telephone number) is provided by the interested party in the context of a service requested by the same, the data thus provided may be used to send communications via e-mail relating to services similar to those previously requested by the user, according to art. 130, comma 4 of Legislative Decree 196/2003, without the need for express and prior consent (so-called soft spam). In any communication, in any case, the user is reminded that he/she can revoke consent at any time and without formalities. The data is deleted at the request of the interested party.

f) Promotional Communications
Innovationclub S.r.l. will send commercial communications to those who make an explicit request, expressing the will, through the appropriate flag, to authorize Innovationclub S.r.l. to process their personal data for the aforementioned purpose.
Consent: The service is provided only after an explicit and unequivocal expression of consent by the user (issued by checking the appropriate box “I have read the Privacy Policy and agree to the processing of my personal data to receive commercial, promotional and advertising information from Innovationclub S.r.l.” on the Site). The provision of data is mandatory only for the purpose of receiving commercial and promotional communications and any refusal will result in the impossibility of using the service, without further consequences.
Purpose: Personal data provided by users (email address and telephone number) will only be used to send the newsletter and will not be disclosed to third parties.
Method of treatment: The data collected will be processed with computer tools, that may be partially automated.
The promotional communication sending service is Rapidmail platform, based in Germany. For more information, please read the Privacy policy available here: https://www.rapidmail.it/protezione-dei-dati.
To cancel service: in order to stop receiving the promotional and commercial communications, simply select the link for cancellation at the bottom of each e-mail or send a specific request to the e-mail address: privacy@chargecar.com
Data cancellation is handled in an automated manner so that further commercial communications may be received for a period subsequent to such request, in any case no later than 72 hours from the request for cancellation, and the sending of which had been planned before the cancellation request was received.

g) Cookies
What are they? The term cookie refers to a small text file that stores brief browsing information on a given website, which will be installed on your device when you log in. Each cookie contains different data (for example, the name of the server it comes from, a numeric identifier, etc.). It can remain in the system for the duration of a session (until the browser is closed) or for long periods and can contain a unique identification code.
When you visit the site again, the cookies will be forwarded back to the site that generated them (first-party cookies) or to those sites provided by third parties who can recognize them (third-party cookies).
Innovationclub S.R.L. wants to reassure you about the security of the cookies on its website: they do not damage your device in any way, but will allow you to browse faster, offering you a better experience.
What are they used for? Cookies are used for different purposes depending on their type: some are strictly necessary for the proper functioning of a website (technical cookies), while others optimize performance to offer a better user experience or to allow the acquisition of statistics on use of the site, such as cookies analytics or allow the display of personalized advertising, such as profiling cookies.
The Innovationclub SRL website uses both cookies that do not require your consent for their installation (such as technical cookies), and cookies that require your prior consent in order to be used (such as profiling cookies).
In particular, the following can be activated on the site:

a. Technical and functional cookies (which DO not require your consent):
These cookies are necessary for the operation of the site and allow you to access its functions (so-called browsing cookies) or to authenticate yourself in the session.
The use of functional cookies is also provided, which allow you to store your preferences and settings, thus improving your browsing experience on the website.
To ensure their functionality, these cookies are not normally deleted when you close your browser; however, they have a predefined duration (usually up to 2 years) and after this period they are automatically deactivated. These cookies and the data they collect will not be used in any way for further purposes.
The installation of technical cookies takes place automatically following access to the website or to activate certain features (e.g. by selecting the “remember me” option). You can always choose to disable them by changing your browser settings at any time, but you may encounter some problems viewing the site.

a. Anonymous analytic cookies (which DO not require your consent):
These cookies keep track of the choices made on the site and the data related to navigation, in order to carry out statistical analyses, in anonymous and aggregate form.

c. Tracking, profiling and marketing cookies (which require your CONSENT):
This site also uses third-party cookies for tracking purposes for marketing and profiling, the installation of which is subject to your prior consent issued through the banner or even managed at any time through the Cookie Policy.
Profiling cookies can include several categories, including advertising profiling, retargeting or social cookies.
• Advertising profiling cookies: create a user profile that allows you to view advertising content in line with the preferences expressed while browsing the site;
• Retargeting cookies: they are created in order to send you advertising content related to the products you have purchased or viewed on the site and in which you have expressed interest;
• Social cookies: this site provides for the installation of cookies related to social network plug-ins. These cookies are managed directly by third parties and allow you to view advertising messages in line with your preferences.
When you access the site, a special banner you will inform you of the presence of profiling and retargeting cookies and allow you to consent or not to their installation, possibly selecting the individual cookies you want to install.
You may at any time revoke the consent previously given, without prejudice to the possibility of visiting the site and using its contents.
The installation of profiling, retargeting, analytical and social cookies, including any other activity connected to them, is managed through third-party services. Disabling through Browser

4. For what purposes will you use my data?
Your personal data will be used in order to:
1. Allow you to browse the site;
2. Allow you to register on the site;
3. Allow you to use and manage your personal account;
4. Allow you to send us communications for possible collaboration through the dedicated section;
5. Ensure adequate support in relation to your needs or requests;
6. Comply with requests from public and governmental authorities;
7. Manage any disputes and therefore defend the rights of Innovationclub SRL, both judicially and out-of-court.
These purposes are jointly defined as mandatory purposes, because the provision of your data is necessary for their pursuit.
Exclusively with your prior consent:

Your data may be used to carry out market surveys in order to improve the experience and quality of the services offered and to send you commercial communications from Innovationclub SRL through suitable means of communication (such as e-mail or direct mail, SMS or telephone calls), regarding the products and services offered, special events or promotion of dedicated offers.
These purposes are jointly defined as optional purposes, because the provision of your data is always left to the free choice of the interested party, in relation to the single service that they want to use.
In order to be sure that we process your personal data for the purposes defined in this Section, we inform you that:
• the mandatory purposes are such because they are necessary for the registration, use and provision of the services offered by the website. Therefore, if you do not intend to provide us with your personal data for these purposes, you will not be able to browse and register on the Site and you will not be able to use the individual services offered by Innovationclub S.R.L.;
• marketing purposes are discretionary, failure to consent to their execution will make it impossible for Innovationclub SRL to send you commercial communications. You may at any time revoke the consent previously given for these purposes, by sending a communication to the email address indicated in the section “How can I contact the Data Controller or handle my complaints?” or request cancellation from the service by selecting the opt-out link at the bottom of each communication.

5. What is the legal basis for processing?
With reference to the purposes indicated in the previous point, the legal basis used is as follows:
• For data concerning navigation on the site (point 1), the legitimate interest of Innovationclub SRL in the proper functioning of the site and the safety of navigation;
• For the activities referred to in points 2, 3, 4 and 5, the provision of the service you have requested and the fulfillment of contractual services or the execution of pre-contractual activities;
• For orders from the Authority (point 6), the fulfillment of a legal obligation on the holder;
• For the protection of the rights of the holder (point 7), the legitimate interest of the holder in the defense of his/her rights;
• For the sending of marketing communications and statistical surveys (point 8), your free and informed consent or the legitimate interest of the Data Controller, if the user has already expressed their interest in our services and products.

6. Who will you share my data with?
In compliance with the purposes indicated in the previous section, the staff of Innovationclub SRL may be responsible for processing your data, in order to provide you with the services, information or support requested.
Therefore, access to your personal data will be expressly authorized by the Data Controller or, if necessary, may appoint the subjects to whom it is addressed for the provision of services and for the activities of its competence as Data Processors pursuant to Articles 28 and 29 of the GDPR.

We would also like to remind you that the list of authorized subjects and Data Processors is available at the registered office of the Data Controller or alternatively, you can request it from them using the addresses indicated in the section “How can I contact the Data Controller or handle my complaints?”.

7. How will you process my data?
Your personal data will also be processed with the help of electronic means for the time strictly necessary to achieve the purposes envisaged with the collection.
Innovationclub S.R.L. will adopt the technical and organizational measures necessary to prevent the loss, illegal or incorrect use of data, in addition to preventing any form of unauthorized access by third parties.
Therefore, Innovationclub SRL will guarantee the security of your personal data, limiting the number of subjects to whom access to servers or databases will be allowed and providing protection systems aimed at avoiding the risk of cyber attacks.

8. Is my data processed outside Europe?
The data processed by Innovationclub S.R.L. resides on servers located within the European territory.
However, some cookie service providers are based in countries outside Europe, in particular the United States, as specifically indicated also in our Cookie Policy.
In these cases, personal data also resides on servers located in the United States, but they are always in compliance with the provisions of articles 45 et seq. of the GDPR. Therefore, all the necessary precautions will be taken in order to guarantee the fullest protection of personal data based on such transfer: a) on adequacy decisions of the recipient third countries expressed by the European Commission; b) on adequate guarantees expressed by the recipient third party pursuant to art. 46 of the Regulation; c) on the adoption of binding company rules, so-called Corporate binding rules.
These requirements are always guaranteed by the service providers of Innovationclub S.R.L.

9. How long will you retain my data?
Innovationclub S.R.L. will process your personal data for the time reasonably necessary to only achieve the purposes listed above, which can be consulted in the Section “For what purposes will you use my data and through what legal bases?”.
At the end of the retention period, your personal data will be erased or irreversibly made anonymous and aggregated.

11. What are my rights and how can I protect my privacy?
In relation to your personal data and in accordance with the provisions of the GDPR, Innovationclub SRL informs you that you have the right to request:
• access to your data;
• the modification and rectification of any errors in our databases relating to your data;
• deletion of your data if it is held in the absence of legal requirements;
• the limitation of the processing of your data;
• opposition to the processing of data;
• data portability.

  • Ask for confirmation of any processing regarding your personal data;

Cancellation/

Right to be deleted

You can request deletion of your personal data, but only if:

  • Its permanence is no longer necessary in relation to the purposes for which it was collected;
  • You have denied your consent previously given (where the processing is based on consent);
  • The processing was carried out illegally;
  • It is necessary to comply with a legal obligation to which Innovationclub SRL is subject (in relation to an order from an Authority).
Limitation You can request to limit your personal data, but only if:

  • Its accuracy has already been challenged;
  • It is no longer necessary for the purposes for which it was collected, but there is a legal dispute about its use;

However, following your request for limitation, the use of your personal data is allowed when:

  • Your consent remains in any case;
  • It is necessary to exercise or resist legal action;
  • To protect the rights of another natural or legal person involved in the processing.
Portability You can request a copy of your personal data in a structured, readable and commonly used format.
Opposition You can object at any time to the processing of your personal data when:

·         the lawfulness of the processing is based on the legitimate interest of the data controller;

·         personal data is processed for direct marketing purposes including profiling to the extent that it is related to such direct marketing.

When you object:

·         processing for direct marketing purposes, personal data will no longer be processed for these purposes;

·         in the case of the legitimate interest of the data controller, the processing may continue only if the data controller demonstrates the existence of legitimate compelling reasons to proceed with the processing that take precedence over the interests, rights and freedoms of the data subject or for the establishment, exercise or defense of a right in court.

The right to object can also be exercised by automated means that use technical specifications, such as those made available on the website in the personal page and in emails (link for deletion).

Innovationclub S.R.L. guarantees that any request regarding your rights will be acknowledged within thirty days of receipt.
If you believe that the processing carried out by Innovationclub SRL is unlawful or involves a clear violation of the provisions of the GDPR, you have the right to submit a complaint to the competent supervisory authorities (for Italy the Guarantor for the protection of personal data). Further details are given in the following section.

12. Can I file a complaint?
You have the right to submit a complaint to the Guarantor Authority for the protection of personal data, if you believe that the processing carried out by Innovationclub SRL does not comply with the provisions of European Regulation no. 679/2016 and national legislation.
In Italy, the competent authority is the Guarantor for the Protection of Personal Data, whose contact details are available at http://www.garanteprivacy.it/.
